Il problema della giurisdizione nel trasporto aereo di persone e nei pacchetti turistici

The Author addresses the problem of identifying the criteria to determine the jurisdic-tion in air transportation and in package travel, pointing out how it represents one of the most relevant issues for effective protection. The review of the reference regulation highlights the different choices adopted by the leg-islator in the two sectors analyzed (for the passenger of air transportation and for the consum-er purchaser of package travel) and a difficult connection between sources of law. Il contributo affronta il problema dell’individuazione dei criteri per de-terminare la giurisdizione nel trasporto aereo di persone e nella disciplina del pacchetto turistico, ponendo in luce come esso rappresenti uno dei punti più rilevanti della effettività della tutela. L’esame delle normative di riferimento pone in luce differenti scelte adottate dal legislatore nei due settori analizzati (per il passeggero nel trasporto aereo e per il consumatore acquirente di un pacchetto turistico) e un difficile raccordo tra fonti.
