The aim of this study is to offer a brief legal, economic, and social analysis of digital art and crypto fashion, starting from the artistic conception in the perspective of its technical reproducibility in the sense used by Benjamin, that let to understand how the evolution of techniques has allowed it to take ever different forms, up to digital reproduction. With the birth of digital art, new forms of use and commercialization of the artistic product are developed (blockchain). Fashion also becomes the protagonist of the use of new technologies, pursuing the objectives of European Green Deal, up to the possibility of considering virtual objects as assets to be used as a showcase in the Metaverse with its own avatar - digital alter ego in an increasingly "liquid" society according to the concept proposed by Bauman. These problems are examined in a comparative perspective with the Italian model of blockchain regulation in comparison with the experiences of Malta, Switzerland, the Republic of San Marino, and the United States of America to accept the changing needs of crypto-fashion and crypto-art.
L’obiettivo del presente approfondimento è offrire una breve analisi giuridica, economica e sociale dell’arte digitale e della crypto moda, partendo della concezione artistica nella prospettiva della sua riproducibilità tecnica nel senso utilizzato da Benjamin, che consente di comprendere come l’evolvere delle tecniche abbia permesso che essa assumesse forme sempre differenti, sino alla riproduzione digitale. Con la nascita della digital art si sviluppano nuove forme di fruizione e commercializzazione del prodotto artistico, legate alla blockchain. Anche la moda diventa protagonista dell’uso delle nuove tecnologie, perseguendo gli obiettivi di Green Deal europeo, fino alla possibilità di considerare oggetti virtuali come veri e propri asset da utilizzare come vetrina nel Metaverso con un proprio avatar - alter ego digitale in una società sempre più “liquida” secondo la concezione proposta da Bauman. Tali problemi sono approfonditi in una prospettiva comparativa rispetto al modello italiano della regolamentazione della blockchain in raffronto con esperienze di Malta, Svizzera, Repubblica di San Marino e degli Stati Uniti d’America per accogliere le esigenze in divenire della crypto-moda e della crypto-arte.
