The System as Representation of the Contract-in-Itself. Contract’s Necessity According to the Young Marx

In the era of schemes belonging to the Grundriss literary genre the problem of the thing-in-itself is at the centre of various legal speculations, as problem of the representation of law and contract in their essence. Kant’s philosophy does not admit the possibility of knowing the law als Recht an sich and the contract als Vertrag an sich. Law and contract can be objectively represented only as forms of thought that we apply to empirically given legal matter, through which we think of law and contract as objective truths. However, the Grundriss instrument pushes philosophy of that time to reevaluate the possibility of conceiving the object of sensitive intuition as representation of the object itself. The questions addressed in this context are essentially two: is the idea of contract a mere psychic production of the subject or do you have to think that it pre-exists in some way on the metaphysical level? In this second case, how can it connect with historical reality and influence this last one?
