The Author analyzes the responsibility of the Italian Legislator for violation of European Law. Subsequently, the written work takes into consideration the way in wich the Italian judges have implemented the principle developed by the Court of Luxembourg. The article attempts to outline the guidelines in order to elaborate Legislator’s liability for violation of the Constitution.
