Decree-Law No. 92 of July 4, 2024, which introduces Article 314-bis of the Penal Code, has generated a lively debate regarding its impact on crimes against public administration. The measure, characte- rized by regulatory urgency, aims to limit the consequences of the repeal of Article 323 of the Penal Code in line with European obligations, and to ensure continuity between the previous and the new penal regime. In order to understand the scope of the new provision, it is necessary to compare it with the jurisprudential variations concerning the misappropriation of funds. In this regard, the Author adopts an approach based on respect for reasonableness and proportionality, arguing that the new Article 314-bis applies exclusively to acts of profitable diversion of lesser gravity, as opposed to the conduct of "appropriative diversion," which remains punishable by more severe sanctions, specifi- cally those provided in Article 314 of the Penal Code.
Il D.L. 4 luglio 2024, n. 92, che introduce l’art. 314-bis c.p., ha suscitato un vivace dibattito riguardo al suo impatto sui delitti contro la pubblica amministrazione. Caratterizzato da un’urgenza normativa, il provvedimento si propone di contenere le conseguenze dell’abrogazione dell’art. 323 c.p. in aderenza agli obblighi europei, garantendo al contempo la continuità tra il precedente e il nuovo regime penale. Il confronto con le oscillazioni giurisprudenziali riguardanti l’indebita destinazione di fondi è necessaria per comprendere la portata della nuova disposizione; sul punto l’Autore adotta un approccio orientato al rispetto della ragionevolezza e della proporzionalità, sostenendo che l’art. 314-bis c.p. si applica esclusivamente ai fatti di distrazione profittevole di minore gravità, distinti dalle condotte di “distra- zione appropriativa”, che rimangono punibili con pene significativamente più severe, come quelle previste per il peculato.
