This article focuses on the main substantive innovations of the EU contribution to a sustainable international investment law, that is an international investment law aimed at the realization of sustainable development. The European Union has attempted to be a protagonist in this respect. Its aim has been to render international investment law more acceptable, in terms of accountability, cer- tainty, legitimacy and predictability, through the inclusion into international investment treaties of regulatory innovations related, among others, to the safeguard of a few ‘non-investment’interests at the root of sustainable devel- opment. Today the EU protagonism is under pressure. The article aims at assessing this matter from an academic comprehensive perspective to highlight how the EU approach towards the sustainability of international investment law could be more effective.
