The paper aims at analysing how the Italian state regulates the sports industry. The Law 17 October 2023, n. 280, distinguishing the respective spheres of competence of state and sports legal systems, recognised that state has competence over economic issues, reserving the regulation of technical and disciplinary issues to sports legal systems. Despite this exclusive regulatory competence on matters of an economic nature, in reality there is no specific State regulation for the sports industry, thus assimilating it to any other industry.
