Interpretazione e nozioni della Costituzione

The interpretation of the Constitution possesses its specificity, even though the canons that can be used are the traditional ones. This specificity is induced by the peculiar function of the Constitution, which makes the use of these canons combinable in different ways, due to the different structure of constitutional statements: the choice of method must best correspond to that function, which ultimately results in an attempt to bring the choices made by the legislature into conformity with the Constitution.

L’interpretazione della Costituzione possiede una sua specificità, anche se i canoni utilizzabili sono quelli tradizionali. Questa specificità è indotta dalla peculiare funzione della Costituzione, che rende diversamente combinabile l’utilizzo di tali canoni, in ragione della differente struttura degli enunciati costituzionali: la scelta del metodo deve meglio corrispondere a quella funzione, che, in ultima analisi, si risolve nel tentativo di rendere conformi a Costituzione le scelte effettuate dal legislatore.
