Effetto devolutivo dell'appello e motivi assorbiti

The article deals with test reports, in the discipline then in force, including appeal and repetition of motifs absorbed in the first instance. In particles, after having examined the nature of the appeal, rennovation or appeal itself, in order to determine what can be donated to the appeal, and on the concept of negative outcomes, the survey focused on how to present those reasons offered in first degree but not examined by the court of first instance, thus determining the cd absorption (proper or improper). In particular, we tested whether the institution of the absorption is consistent with the principle of correspondence between the requested and delivered, and what are the ways to appeal to them in this order not subject to forfeiture or reduction of procedural protection.

L’articolo si occupa di verificare i rapporti, nella disciplina all’epoca vigente, tra appello e riproposizione dei motivi assorbiti in primo grado di giudizio. In particole, dopo aver vagliato la natura dell’appello, gravame o appello vero e proprio, al fine di stabilire cosa possa essere devoluto in appello, nonché sul concetto di soccombenza, l’indagine si incentrata sulle modalità di presentazione di quei motivi proposti in primo grado ma non analizzati dal giudice di prime cure, determinando così il c.d. assorbimento (proprio o improprio). In particolare si è verificato se l’istituto dell’assorbimento sia coerente con il principio della corrispondenza tra il chiesto e il pronunciato e quali siano le modalità per riproporli in appello al fine di non subire decadenze processuali o diminuzioni di tutela.
