This present paper examines the institution of arbitration starting from the reconstruction and related criticism of the discipline provided by the Code of public contracts. In particular, it seeks to highlight the most critical aspects of the positive discipline, even if measured from the point of view of implementation of the protection that this development has to offer. In addition to aspects of positive law, the long-debated issues about the suitability of arbitration on legitimate interests and the eligibility of unorthodox arbitration and fairness also in cases where the arbitrator is the administration. In fact, from the perspective outlined by the EU legislature and implemented by the national legislature with Legislative Decree no. 53/2010, and before that with enabling act no. 69/2009, arbitration can and must be developed as a tool that can effectively provide protection to the subject (or subjects), public or private, who are believe they are damaged in their subjective legal situations.
Il presente scritto esamina l’istituto dell’arbitrato partendo dalla ricostruzione, e connessa critica, della disciplina fornita dal codice dei di contratti pubblici. In particolare, si cerca di evidenziare gli aspetti maggiormente critici della disciplina positiva, ancorchè valutati in un ottica di implementazione della tutela che tale istituto può offrire. Accanto agli aspetti di diritto positivo si pongono le questioni da sempre dibattute circa l’arbitrabilità degli interessi legittimi e l’ammissibilità degli arbitrati irrituali e di equità anche nelle ipotesi in cui parte arbitrale è l’amministrazione. Infatti, nell’ottica delineata dal legislatore comunitario, e recepita dal legislatore interno con il d.lgs. n. 53/2010, e prima ancora con la legge delega n. 69/2009, l’arbitrato può e deve essere elaborato come strumento effettivamente idoneo a fornire una tutela al soggetto (o ai soggetti), pubblici o privati, che si ritengono lesi nelle proprie situazioni giuridiche soggettive.
