The paper aims to deepen the role of the President of the Italian Republic, Sergio Mattarella, in the entry into force of the legitimate self-defence law reform (l. n. 36/2019). According to the article 73 of the Italian Constitution, the President has signed the bill for its entry into force but at the same time he has written a letter to the Head of the Government and the Parliamentary Chambers' Presidents, realizing in this way a sort of “reasoned promulgation”. In his note, President Mattarella underlines some critical aspects of the bill and suggests a Constitutional oriented interpretation of the new art. 55 of the Italian Penal Code. After a brief report, the essay focuses on the Presidential “escape” from the article 74 of the Italian Constitution, forcing him to refer the bill back to the Parliament for its review, toward hybrid forms of Constitutional monitoring on normative acts.
