The proposed amendments to Regulation (EU) 2016/399 (Schengen Border Code) put forward by the Commission in December 2021 enshrines relevant changes concerning readmissions at the internal borders. Amongst the various legal issues raised by the long-standing practice on the matter, the essay tries to identify the issues settled by the new provisions as well as those left unaddressed, thereby achieving a thorough understanding of the new rules. It then focuses on concerns regarding police controls at the internal borders with equivalent effects to border checks and on the relations of the new rules with the European common asylum system. As a conclusion, the role played by readmissions in the Union’s policy on border checks is highlighted.

La proposta di modifica del regolamento (UE) 2016/399 (Codice Frontiere Schengen) presentata dalla Commissione nel dicembre 2021 contiene importanti novità in tema di riammissioni informali alle frontiere interne. Tra le gravi questioni giuridiche sollevate dalla prassi pregressa in materia, il saggio identifica quelle risolte dal nuovo testo e quelle non affrontate, così da valutare la disciplina risultante. Di questa vengono posti in rilievo i nuovi profili critici in tema di controlli alle frontiere interne aventi effetto equivalente alle verifiche di frontiera e di rapporti con il sistema comune di asilo e commenta la funzione assolta dalle riammissioni informali, ormai portate “a sistema”, nella politica dell’Unione di controlli alle frontiere.
