Abstract

The author, questioning the legitimacy of Italian support for the defense of Ukraine, reconstructs the constitutional discipline in force on war and military actions by identifying three areas: forbidden war, legitimate war and necessary war. The first and third areas include abstract cases subject to specific prohibitions and obligations, while the "legitimate war" includes very different situations: defensive war of support, military, logistic or economic support, international police operations, peace keeping, humanitarian assistance as well as UN-approved war and military operations.
