L’esercizio del culto nell’emergenza sanitaria da Covid-19 in Italia Con l’emergenza sanitaria da Covid-19 l’Italia ha varato norme allo scopo di osteggiare la propagazione dei focolai epidemiologici. Tali norme, inoltre, hanno sacrificato gli impegni assunti con la Chiesa cattolica ex art. 2 Accordo 1984 ed in particolare la libertà di gestione e organizzazione delle attività pastorali. Inoltre, hanno imposto una forte restrizione del diritto di libertà religiosa. Sono state infatti sospese le cerimonie religiose, incluse le messe e i riti funebri per evitare pericolosi assembramenti. Solo di recente il governo ha consentito alcune aperture nel diritto dell’esercizio del culto e, in data, 7 maggio 2020 è stato firmato un Protocollo con la CEI per la graduale ripresa delle celebrazioni coram populo. La questione attiene al bilanciamento tra il diritto alla salute e diritti di libertà. Ma ci si è domandato se tale bilanciamento sia stato effettivamente corretto.
