I TRABOCCHI DELLA COSTA ABRUZZESE: L’“IMMAGINIFICO” RAPPORTO TRA AUTORITÀ E LIBERTÀ

the Region Abruzzo issued regulations for the recovery and enhancement of the “Trabocchi” in the Abruzzo coast, endorsed recently by the Constitutional Court. Thus, a legal qualification was attributed to the works of ingenuity and of art handed down over the centuries, consisting of a peculiar fishing technique using light wooden artifacts placed on the maritime domain. This article seeks to revisit the statute of the “Trabocchi” which would subtract them from the procedures of the Bolkestain directive on the assignment and duration of the related state- owned maritime concessions.

la Regione Abruzzo ha emanato norme per il recupero e la valorizzazione dei trabocchi della costa abruzzese, di recente avallate dalla Corte costituzionale. Così è stata attri- buita una qualificazione giuridica all’opera d’ingegno tramandata nei secoli, consistente in una peculiare tecnica di pesca utilizzando manufatti leggeri di legno posti sul demanio marittimo. Il presente articolo cerca di rivisitare lo statuto dei trabocchi, che li sottrarrebbe alle procedure della direttiva Bolkestain sull’affidamento e la durata delle relative concessioni demaniali marittime.
