Starting from the first years of the new millennium, the collective conscience, also in Italy, has shown a growing awareness for the issue of road safety and for the excessive clemency towards those responsible for serious accidents caused by the multiple violation of precautionary rules. The article examines the law n. 41 of 2016 which introduced into the penal code two new autonomous crimes: the crime of "road murder" (art. 589 bis of the Criminal Code) and that of "personal road injuries" (art. 590 bis of the Criminal Code). More recently the Constitutional Court has declared a part of the law n. 41 of 2016 in the part in which it does not envisage, where privileged aggravating circumstances do not exist, the possibility for the judge to apply, as an alternative to the administrative sanction of the revocation of the driving license, that of the suspension of the license.
