A major limit to the immigration policy of the EU, as implemented through Directive 2003/109/EC, applies in connection with aliens convicted of crimes, since the latter are at the basis of the public policy and public security clause allowing refusal to grant the status of long-term resident (Art. 6), its withdrawal (Art. 9) and the expulsion of its holders (Art. 12). The article reviews the clause with a view to understanding the actual extent of the limit to the immigration policy which it establishes, as compared to the standards set in the case-law of European Court of Human Rights on Art. 8 of the related Convention in connection with the deportation of aliens, on the one hand, and in Directive 2004/38/EC in connection with the expulsion on nationals of other member States, on the other hand.
