The so-called double track against indictable offenders, considered socially dangerous offenders, is functional to reducing the risk of recidivism and therefore cannot ignore the type of crime that is intended to be prevented and of which the crime committed is an expression. To overcome the well-founded doubts of constitutional and conventional illegitimacy of the current system, as well as its known practical application limits, it is no longer possible to ignore the assistance of other empirical sciences, i.e. social, criminological or actuarial ones, as well as possibly also AI, which support, but do not replace, the necessary judicial discretion. These sciences may help, on one hand, the legislator to delimit the scope of applicability of these measures, both in an objective sense, identifying a selective criterion of the crimes involved, based on the relevance of the legal assets endangered by certain persistent crimes, and in a subjective sense, regarding to certain criminological types of perpetrators; and, on the other hand, will be able to assist the judge in the delicate assessment of the social dangerousness of the offender.
Il c.d. doppio binario a carico di soggetti imputabili, ritenuti socialmente pericolosi, è funzionale alla riduzione del rischio di recidiva e pertanto non può prescindere dal tipo di criminalità che si vuole prevenire e di cui il reato commesso è espressione. Per superare i fondati dubbi di illegittimità costituzionale e convenzionale dell’attuale sistema, nonché i suoi noti limiti pratico applicativi, non si può più fare a meno dell’ausilio di altre scienze empiriche, siano esse sociali, criminologiche od attuariali, nonché eventualmente anche dell’I.A., che affianchino, ma non sostituiscano, la necessaria discrezionalità giudiziale. Tali scienze potranno aiutare, da un lato, il legislatore a delimitare l’ambito di applicabilità di queste misure, sia in senso oggettivo, individuando un criterio selettivo dei reati interessati, basato sulla rilevanza dei beni giuridici posti in pericolo da certa criminalità persistente, sia in senso soggettivo, rispetto a determinate tipologie criminologiche di autori; e, dall’altro lato, potranno essere d’ausilio al giudice nel delicato accertamento della pericolosità sociale del reo.
