Non-contributory Social Benefits to European Citizens Article 70 of EU Regulation No. 883/2004 defines special non-contributory cash benefits as those social benefits intended to provide supplementary, substitute or ancillary coverage of risks corre-sponding to the branches of social security, listed in Article 3(1) of the EU Regulation No. 883/2004, and to guarantee, for the persons concerned, a minimum subsistence income in relation to the economic and social context of the member state concerned. Such social benefits have been the focus of Court of Justice rulings over the past decade. The European courts have intervened by restricting and later expanding the possibilities for European citizens to access such benefits. The contribution aims to examine such case-law. In particular, the paper analyzes the recent Jobcenter Krefeld and CG rulings to understand whether the European courts have gone beyond the interpretation offered in Dano, which restricted access to such social benefits by European citizens.
