I Trattati UE e il via libera all’uso del MES “senza condizionalità”

I TRATTATI UE E IL VIA LIBERA ALL’USO DEL MES “SENZA CONDIZIONALITÀ” L’Eurogruppo, con l’avallo dal Consiglio europeo, ha proposto di rendere possibile l’assistenza finanziaria del MES alla sola condizione di utilizzare le relative risorse per le spese sanitarie dirette e indirette, di cura e di prevenzione relative all’emergenza sanitaria da COVID-19, per l’ammontare del 2% del PIL calcolato alla fine del 2019. Questa proposta stride con la formulazione letterale dell’art. 136, par. 3 TFUE e anche con la sua interpretazione sistematica, con l’eccezione di un aspetto, ma risulta giustificabile grazie al criterio teleologico di interpretazione del diritto UE. L’articolo puntualizza anche alcuni aspetti della proposta che sono decisivi per la sua coerenza con i Trattati UE. THE EU TREATIES AND THE GREEN LIGHT TO THE USE OF ESM “WITH NO CONDITIONALITY” The Eurogroup, with the acknowledgement of the European Council, put forward the proposal to make available financial assistance from the ESM, upon the sole condition on the use of the relevant credit line to support domestic financing of direct and indirect healthcare, cure and prevention related costs due to the COVID 19, up to 2% of the respective Member’s GDP as of end-2019. This proposal is incompatible with the wording of Art. 136, para. 3 TFEU as well as with its legal context in EU law, with the exception of one point, but it appears to be justified in the light of the purposes of the economic policy of the EU. The essay also points out some features of the Eurogroup proposal which are key for its consistency with the EU treaties.
