This article offers an introduction to the Cape Town Convention on International Interests on Mobile Equipment and its Protocols, starting with the elements that constitute its basic legal framework (the functional approach; the international registry; the enforcement measures) and then focusing on the Aircraft, the Luxembourg Rail and the (then) draft Miniing, Agricultural and Construction Protocol (MAC Protocol) and their impact in Africa. One of the aims of the article is to highlight the desirability of modernising the domestic law approach to secured transactions, in order to facilitate financing and access to credit and attract investments, especially in strategic markets such as the ones covered by the Cape Town Convention.
