Abstract

The study, through the testimonies obtained from technical sources and the juridical analysis of historical episodes, shows that the practice of forensic art by women, in a very limited but also very precise series, has been in the Roman experience consequence of extemporaneous and unrepeatables conditions. The prohibition that forbade the female universe any contact with a public function was rigid and shared by a society with a marked masculine imprint. This deminutio was inherent in the nature of gender, burdened by the preconceptions of levitas animi, infirmitas sexus and other preclusives obstacles. The woman who speaks in public, defends herself and and others, represents a significant but confined exception to a rule that, mutatis mutandis, in the Italian legal system, a filiation of the Roman legal system, has resisted until the twentieth century.
